Booking
Conditions for Villa and Apartment Rentals
The following booking conditions relate only to the rental of a privately
owned villa or apartment, where we act as agent for the owners.
Booking
Contract and Payment
No contract exists between us until we are in receipt of a 30% deposit
or the full amount if the booking is made within 6 weeks of departure
date and a confirmation has been issued by us.
The person making the booking is responsible for the total cost of the
holiday booked and for any other services booked through us and books
on behalf of and with the consent of all persons for whom the booking
is made.
Full payment of the balance due must be paid at least 6 weeks before departure.
If we do not receive the balance by this date we reserve the right to
cancel the booking and charge the applicable cancellation fees as shown
below.
The cost of your rental property includes water, electricity, gas, maintenance
of gardens and pools, linen and towels (not beach towels) – with
the exception of some winter rentals which are agreed individually.
Cancellation
or Alteration
If you or any member of your party needs to cancel your booking or part
of it, you must notify us in writing by prepaid recorded delivery letter.
The following cancellation fees will apply depending upon when the notification
of cancellation is received by us and the period before your booked date.
More than 6 weeks – 30%
Within 6 weeks – 50%
Within 4 weeks – 70%
Within 2 weeks – 100%
Departure date or after – 100%
Cancellation
by us
We reserve the right in any circumstances to cancel your holiday if such
circumstances arise. If this has to be done, we will offer you an alternative
property of comparable standard or return to you all money you have paid.
Alteration
by us
In the unlikely event of us having to alter your holiday we reserve the
right to do so although we will notify you as soon as reasonably possible
if there is time before the departure date.
In the event of a major alteration to your holiday you may accept the
alteration, or accept an alternative holiday offered by us or cancel your
holiday.
If you cancel your holiday we will refund all monies received from you
in full and final settlement.
Responsibility
for Damage and Behaviour
The person who makes the booking shall be responsible for and shall indemnify
us against all actions, loss, damages and costs whatsoever arising in
consequence of any claim by any person arising out of any act of default
on the part of any member of the party.
We reserve the right to terminate without notice the holiday of any person
whose conduct or behaviour in our opinion justifies such action. If we
do, we will have no further responsibility or liability for the provision
of any further accommodation or other services and no liability to refund
any part of the price paid for that persons holiday.
Property
Description
All information supplied has been compiled from up to date information
and given in good faith. Nevertheless, there may be occasions when an
advertised facility is either altered or not available due to circumstances
beyond our control.
Our
Liability
We accept responsibility for those arrangements wholly in our control.
We do not however accept any liability for any actions or omissions beyond
our control which affects your holiday.
Insurance
All persons must have their own personal holiday and accident insurance
and no liability will be accepted by us whatsoever.
Client’s
Additional Conditions
Clients will keep the property in a tidy and clean condition.
No items must be removed from the rental property during your stay even
for short periods.
The property you rent is only for the people originally booked and any
sub-letting, sharing or assignment is not permitted. Only persons listed
on the booking form may occupy the rental property.
The maximum occupancy is shown and should not be exceeded.
Management services such as cleaners, pool and garden maintenance and
property repairs are provided by third parties suppliers, contracted directly
by the owners, over whom we have no direct control. They have the right
of access to the property at any time, with due regard to your convenience,
for the purpose of inspection of the property and to carry out any essential
repair or maintenance work.
The presence of animals, birds and insects in the surrounding countryside
and on occasion living in inaccessible places such as eaves and attics,
is inevitable. Visitors are warned that, to some extent, this is normal
and we cannot take action to eradicate this unless the presence of such
pests is deemed a serious nuisance.
Where a property is part of the local community, occupiers should be aware
that villages can be noisy places. If this is likely to give offence,
we suggest you reconsider your choice of property.
We accept no liability for intermittent failures of public supplies
or utilities over which we have no control, nor of sewage systems,
plumbing or mechanical equipment in the properties but shall use
our best endeavours to arrange prompt repairs.
Should you not return or lose a set of keys then a replacement charge
will be applied.
Arrival
and Departure Times
To ensure that the property you are renting is cleaned and ready for your
arrival please do not arrive at the property before 2 pm on the first
day of your holiday.
The latest arrival time is 10 pm unless notification of flight delays
have been made to us.
On your last day at the property you should leave the property by 10 am.
If the property is not vacated by 10 am we reserve the right to charge
for additional occupancy on a full day basis.
Please inform us of your flight arrival time at least 10 days prior to
the start of your holiday.
If you experience travel delays please telephone your contact to let them
know your expected time of arrival.
We cannot guarantee that the cleaning will have been completed and that
the cleaners will have left the property prior to your arrival.
Damage
Deposit
An additional deposit must be paid on arrival at the property and
will be held on account and returned if no damages and other charges
are used against it at the end of your holiday.
Any damage is to be reported immediately to our personnel.
You are requested to replace breakages where possible prior to your departure.
If the damage deposit proves inadequate to fully cover any costs that
arise, we reserve the right to invoice you for immediate payment.
Directions/Contact
Details/Key Collection
Directions, contact and key collection details to your rental property
will be sent immediately after receipt of the final payment.
Passports
and Visas
It is the responsibility of all those travelling to ensure that they are
carrying the correct and necessary passports, visas and other documents
for travel and for driving in the relevant country. Any person who through
drink or drugs is reasonably refused carriage or service shall have no
claim against us.
Disputes
All claims and complaints must be notified to our personnel who will do
their utmost to rectify any such complaint. If such complaint cannot be
resolved it should be made in writing to us by prepaid recorded letter
to reach us within 14 days from the end of your holiday. No claims or
complaints can be dealt with if notified outside this period.
These
terms and conditions and all matters arising from them are subject
to Spanish law and to the jurisdiction of the Motril courts.
